## Before you fax

- The state that counts is where the corporation's principal business, office or agency is, not where the owners live.
- If you fax the election, keep the signed original with the corporation's permanent records.
- A late election must say "FILED PURSUANT TO REV. PROC. 2013-30" in the top margin. Some late elections can instead be attached to Form 1120-S.
- The IRS says filing information may change and points to IRS.gov for the latest.

## Steps

1. Fill in Form 2553 and have every shareholder sign where required.
2. Scan or photograph every page.
3. Pick the number for the state of the principal business and enter it.
4. Send, keep the delivery receipt with the original, and watch for the IRS's notice.

## Questions

**How long until the IRS confirms the S election?**

Generally within 60 days of filing. If you checked box Q1, the IRS sends a ruling letter and it generally takes about 90 days more.

**What if I hear nothing?**

The IRS suggests calling 1-800-829-4933 if no notice arrives within 2 months of filing, or 5 months if box Q1 was checked.

**Can I mail it instead?**

Yes. Mail the original (no photocopies) to the service center in Kansas City, Missouri or Ogden, Utah, the same split by state as the fax numbers.

**Do the numbers change?**

They can. We compare them with the IRS instructions regularly; the date we last checked is at the bottom of this page.
